Polk County solar lien search
By Jake Breaux, solar industry expert · Updated
The short version
In Polk County, Florida, a solar fixture filing is recorded with the Clerk of the Circuit Court and Comptroller, not with the Florida Secured Transaction Registry. The clerk's Official Records search is free, and it gives you four tabs and no address search at all, so your name is the only way in. The other thing to know is that the document type list carries three separate entries called FINANCING STATEMENT, each with a different code, and only one of them holds current filings.
Where do you search for a solar lien in Polk County?
In the Polk County official records, which the Clerk of the Circuit Court and Comptroller keeps as County Recorder. A solar lien is usually a UCC fixture filing, and Florida sends fixture filings to the clerk of the circuit court rather than the state registry. A clean search at the registry does not clear a house in Lakeland, Winter Haven, Bartow or Haines City.
The statute draws the line itself.Florida Statute 679.5011sends a financing statement to the office of the clerk of the circuit court when the collateral is goods that are or are to become fixtures and the statement is filed as a fixture filing, and sends every other case to the Florida Secured Transaction Registry, the state index at floridaucc.com. So the registry is the wrong window for panels bolted to a Polk County roof, and the clerk'sOfficial Records searchis the right one. The version of this rule for every state is onwhere to search for a solar lien.
One thing to settle before you start, because it makes the office look like two offices. The mailing heading on the clerk's contact page reads Polk County Clerk of the Circuit Court and Comptroller, while the records search prints its own title as Stacy M. Butterfield, CPA, Clerk of the Circuit Courts and Comptroller. Singular on one page, plural on the other. It is the same office and the same index.
How do you search the Polk County official records?
The search opens with no disclaimer to accept and nothing to sign into, and it gives you four tabs: Party, Document Type, File Number and Book/Page. Four is all there is. There is no address search, no parcel search and no legal description search, which is where most people stall, because checking your own house by its address is the obvious move and this system will not do it. Your name is the way in.
The Party tab has one box and no grantor or grantee choice to make, so one search covers both sides of a filing. Its own help line gives you the format: last name then first name, with Smith Al as the example, or a company name, with Gulf Utility as the example, and it tells you to use no commas between the first and last names. That comma is the single most common reason a Polk search that should hit comes back empty. Then set the From and To dates or leave them blank, and use the 7 Days, 30 Days and 90 Days buttons underneath if you only want what has landed lately.

Which document type codes do you tick?
The Document Type box on the Party tab is optional, and under it sits a scrolling list of codes with a filter box over it that searches by name or by code. Type FIN into that filter and the Polk problem appears at once. There are three separate entries whose names begin FINANCING STATEMENT, each on a different code: FINANCING STATEMENT/UCC is FINST, FINANCING STATEMENT is FS, and FINANCING STATEMENT again is F STMT. Nothing anywhere in the list says fixture filing.
We searched all three on 6 October 2026 to see which one is alive. FINST is: 21 documents under it had been recorded that same day. FS came back with filings reaching to January 1990 and nothing recent. F STMT came back with nothing at all. So tick all three rather than guessing which era your paperwork landed in, and tick AMENDED FINANCE STATEMENT (A FS), RELEASE FINANCE STATEMENT (REL FS) and SECURITY INTEREST (SEC INT) while you are in the list. If you are chasing a payoff instead, the codes you want are CONTINUATION (OF ANY KIND) as CONTIN, TERMINATION (OF ANY KIND) as TERM and ASSIGNMENT (OF ANY KIND) as ASG.
Results arrive under columns for Name, Date, Type, Book, Page, Legal, File#, Status and Flag. The search stops at 1,000 rows and tells you the real total was higher, so if you see that warning, add a first name or a date range rather than paging through. Two more habits save a second trip: search both names on the deed, since a filing made against one spouse will not surface under the other, and search the trust or company name if the house is held in one.
What does the Verified as of date mean?
It is the small dark red line sitting under the clerk's name at the top of the search. When we checked on 6 October 2026 it read 10/04/2026. It is not the end of the index: documents recorded on 6 October were already coming back in our searches, 21 of them under FINST alone. Read it as the date the clerk vouches for, with everything after it visible but not yet promised. Read it on the day you search rather than trusting ours.
The two ends of the pipeline move in opposite directions here, and that is the part worth holding on to. A document filed electronically is, in the clerk's words, typically recorded the same day, and whoever filed it can pull a stamped image straight away. But the clerk's own alert service says every recorded document goes through a verification process before it is viewable in a public records search, and that this typically takes 5 to 7 business days. So your search is strong on the last few years and soft on the last fortnight. A clean result is good evidence, not a title opinion, and if you are selling, the search that counts is the one your title company runs.
What is the Property Alert Service, and should you use it?
It is free, the clerk runs it on the clerk's own site, and it is the half of this job worth setting up once and then forgetting. What makes the Polk version better than most is what you are allowed to watch: a parcel ID, rather than a name alone. That matters for a fixture filing, because the thing a solar filing attaches itself to is your land, and a parcel ID does not care how somebody typed your name. You can register party names as well, and the clerk warns that every variation has to be registered separately if you want an alert on it.
Coverage is broad: any document carrying a legal description for real property, plus anything matching a registered party name whatever its document type. There is no cap on how many people watch the same parcel ID or name, so a couple can both subscribe to the same one. The alert goes out when verification finishes, which puts it on the clerk's 5 to 7 business day clock rather than the same afternoon. Sign up on the clerk'sProperty Alert Servicepage.
What do you do if you find a solar filing?
Open the image and read who filed it and what it covers. Printing an uncertified copy at home is free, and that is enough to read it. A paper copy from the clerk is $1.00 a page up to 14 by 8 1/2 inches and $5.00 a page above that, certifying one is $2.00, and if you ask the clerk's staff to run the search for you it is $2.00 per year searched. You only need the certified version if somebody at a closing asks.
If the filing secures a solar loan you have paid off, ask the lender for a UCC-3 termination and have it recorded, then come back in a couple of weeks and search again with TERM ticked as well as FINST. If it protects a lease or power purchase agreement that is still running, ask the provider in writing what they need for a sale or a refinance, and ask now, because their reply is the slow part.
What makes any of it matter at a closing is the buyer's lender.Fannie Mae's Selling Guiderequires a UCC search on a home with solar and requires a filing that ranks ahead of the mortgage to be subordinated before the loan closes. The closing-table version of this is atselling a house with solar.
Does every kind of solar leave a filing?
No. Loans nearly always do, leases and power purchase agreements often do, and cash purchases and subscriptions leave nothing on the record. The breakdown is ondo solar panels put a lien on your house. We sell subscriptions, the no-filing kind, so read it knowing that.
Looking at solar for a Polk County home?
Run your bill through the estimator. It takes about a minute and a real person follows up with figures for your roof. Read the Florida page first: it covers who insures the panels when a hurricane comes and who this is a bad fit for.
